SUMMARY:

Edgewater Preserve Phase 1, recorded at Map Book 64, Page 150, in Surveyor Note 5 dedicated Tract D to the Edgewater Preserve Homeowners Association for a stormwater management pond. In Surveyor Note 11, Tract H, J, and L were given to the City of Edgewater. Tract L, which is adjacent to Tract D, had a road constructed to provide access to the Stormwater Pond on Tract D. The dirt road also served as access to the land locked property owner to the west at parcel 841400000040. The dirt road straddles the boundary line of both Tract L and Tract D. To provide legal access to the owner at parcel 841400000040, Development Services requested from Lennar an easement over tract D, however the easement created liability issues for Lennar. As such, City staff has work with Lennar to accept that portion of Tract D where the dirt road occupies. The City owns Tract L and the addition of Tract D, which encompass the entire dirt road, will allow legal access through City owned property. This Quit Claim Deed will settle ingress and egress concerns regarding the land locked property owner at parcel 841400000040. It is envisioned that the properties to the North of parcel 841400000040 will be developed, and legal access will be provided to said owner of parcel 841400000040 through that future development. The City, at that time, will then turn over Tract L, Tract J, and that portion of Tract D to the HOA of Edgewater Preserve.
