COUNCIL AGENDA ITEM
SUBJECT: Rescindment of an Action Taken by Council.
DEPARTMENT: Administration
SUMMARY: A request for a contract extending Insurance Agent of Record/Broker Services with Brown and Brown for an additional year was denied by the City Council at their regular meeting of August 3, 2020 by a vote of 3-2. This extension would have been an amendment of the original contract entered into on September 25, 2020, which allowed for two one-year additions. Those voting against the idea were Vice Mayor Conroy, Councilwoman Yaney and Councilwoman O’Keefe. Those voting in favor of the extension were Mayor Thomas (who passed the gavel to the Vice Mayor in order to second the motion made by Councilwoman Power) and Councilwoman Power. Later, one of the members of Council who voted against an extension approached the City Manager indicating they wished to have their vote reversed.
According to Robert’s Rules of Order, this request is for a ‘rescindment’ of an action. As quoted from the rulebook: If the purpose is to completely cancel a previous action that the group has taken, the motion to rescind is the one to use. Furthermore, to set this into action, a person on the ‘winning’ side of the vote must make a motion to rescind the action.
During the August 3, 2020 meeting questions of staff were asked by members of the Council. Many pertained to the Request for Proposal from September 2017. A packet answering most if not all of these questions is included with this packet. It is titled ‘Notice of Recommendation, #RFP 17-HR-014, Date: September 15, 2017’.
BUDGETED ITEM: N/A.
BUDGET AMENDMENT REQUIRED: No.
RECOMMENDED ACTION: Move to rescind the motion adopted at the August 3, 2020 meeting and motion to approve a one year extension of the Brown and Brown Contract to expire on September 24, 2021
