SUBJECT: Transportation Impact Fees - Interlocal Agreement

SUMMARY: The Governor signed House Bill 479 having to do with Mobility Funding Systems and Impact Fees and this new law becomes effective October 1, 2024. The bill provides if a county or municipality charge developers of a new development a fee for transportation capacity impacts, the county and/or municipality must by October 1, 2025 do one of two things:
• Create and execute an interlocal agreement to coordinate the mitigation of transportation capacity impacts, or
• Establish a process to collect and distribute the collected revenues.
If no interlocal agreement exists, the developer receives a 10% reduction in the impact fees and proportionate fare share agreements.
Currently, Edgewater requires developers to contact the County and work with them on calculations and payment of impact fees and staff prefers this stay the same. The interlocal agreement in your packets would accomplish this.

BUDGET AMENDMENT REQUIRED: No
RECOMMENDED ACTION: A motion to accept the interlocal agreement as presented to keep County Transportation Impact collections and remittance status quo. The Mayor would need to sign the document and the City Manager would attest to his signature.
