COUNCIL AGENDA ITEM
SUBJECT:
title
Wastewater System Utility Service Agreement between the City of Edgewater and Deering Park Development Company, LLC
body
DEPARTMENT:
Environmental Services
SUMMARY:
The City of Edgewater Wastewater Treatment Plant has a permitted capacity of 2.75 million gallons per day (MGD) and its sanitary sewer collection system serves approximately 10,000 existing accounts with a 12-month average flow of approximately 1.51 MGD. There are already outstanding commitments to serve approximately 1,000 more units, which leaves available capacity for approximately 5,000 additional units. Deering Park has entitlements which exceed the existing capacity of the Wastewater Treatment Plant. This is in addition to the proposed and envisioned development plans which may arise from other property owners throughout the City over the next 20 to 30 years.
The subject agreement stipulates a timeframe for construction of Deering Park in phases, including a requirement that wastewater impact fees from one phase be fully paid before additional capacity is reserved for future phases. Prior agreements allow Deering Park to transfer paid impact fees among its different phases and properties without increasing the total number of units, this agreement details the process and limitations for such transfers. The subject agreement intends to outline various improvements to increase the wastewater collection/transmission system capacity, including some work which was already completed by Deering Park Development Company (DPDC) that is eligible for impact fee credits.
