2nd Reading - Ordinance No. 2023-O-14: Amending the Code of Ordinances by adding Chapter 15.5 (Right-of-Way Regulations)

SUMMARY:
With the influx of telecommunication and other structures and facilities being placed in the public rights-of-way it is important to implement reasonable rules for the use of those rights-of-way.
Chapter 15.5 (Right-of-Way Regulations) establishes policies and regulations to minimize disruption of services in the public right-of-way including:
• Registration of telecommunication or other utility providers;
• Suspension of permits;
• Construction within the right-of-way;
• Insurance and Indemnification; and
• Enforcement remedies
Council approved this Ordinance at first reading on October 2, 2023 and at second reading on November 6, 2023 a motion was made to postpone the reading until December 4, 2023 for additional review and possible changes.
The ordinance as presented herein is believed to include all modifications necessary to make it compliant with State Statute. The City’s attorney, at the meeting, will outline all changes made. In the interim, all changes to the ordinance are shown in red underlined print.
