ITEM DESCRIPTION:

Title

2nd Reading - Ordinance No. 2019-O-24: Amending the language implementing the Impact Fee program set forth Article XVII (Development/Impact Fees) of the Land Development Code.

Body

REQUESTED ACTION: Approval of the amendments to Article XVII (Development/Impact Fees) of the Land Development Code.

Background:   The City contracted with Mead & Hunt to complete an Impact Fee Analysis and update the Impact Fee Program. Impact fees are a fee charged by governments to developers/builders as a total or partial reimbursement for the cost of providing additional facilities or services needed as a result of new development (e.g. new roads, schools, parks etc.).

This analysis includes a review of the City’s impact fee ordinances, population estimates through 2038 and recommendations for impact fee adjustments to support projected growth. It offers the following fee components for the City of Edgewater:

•                     Police

•                     Fire

•                     Recreational Parks and Open Space

•                     Transportation

•                     Utilities

The amendments to the following areas of Article XVII are proposed based on the Impact Fee Analysis:

•                     Review of Fees

•                     Formula used to determine appropriate impact fees

•                     Refund of fees

•                     Deletion of language requiring payment upon issuance of a building permit, per Florida Statutes

At their regular meeting of October 9, 2019, the Planning and Zoning Board voted to send a favorable recommendation to City Council. This request was continued from the November 18, 2019. City Council approved the request at first reading on December 2, 2019.

RECOMMENDED ACTION

Motion to approve Ordinance No. 2019-O-24.
