SUBJECT:

title

Second Reading Ordinance 2020-O-16 Chapter 12 Offense Section 12-2 Trespassing

body

DEPARTMENT:

Police Department and Parks & Recreation

SUMMARY:

Due to the many requests from citizens and number of calls for service in City Parks over the last year, the City Manager asked the Police Chief to research other city’s ordinances regarding trespass warnings.  The City of Daytona Beach in the last year approved a stronger ordinance authorizing the City Manager and Police Department to issue trespass warnings on or within city facilities, building, or outdoor area, including municipal parks.

The proposed ordinance and signage is similar to the City of Daytona Beach Trespass Ordinance and corresponding signage.  This proposed ordinance provides a clear and concise authorization to the City Manager and City of Edgewater Police Department to issue trespass warnings for rule violators, not just law violators. (See attached Proposed Rules). The proposed ordinance also clarifies the steps required to trespass. Additionally, this proposed ordinance protects the First Amendment Rights of the person issued a trespass warning.
