Background: The subject property is currently vacant and located east of Air Park Road, north of 22nd Street and south of the new Glenbrooke subdivision.

An amendment to the Official Zoning Map shall occur simultaneously with the Future Land Use Map Amendment.

The applicant is proposing to develop the property with 111-unit townhouse units. The PUD Agreement associated with the Zoning Map amendment shall address development requirements including, but not limited to, setbacks, required infrastructure and ownership and maintenance of all common areas.

Prior to development of the subject property a Preliminary Plat and Subdivision Construction Plans or Site Plan must be approved. A Traffic Impact Analysis and Environmental study, to include listed species and wetlands, shall be reviewed with the constructions plans; any improvements and/or required mitigation will be the responsibility of the developer. A bald eagle nest has been identified on the subject property; the developer will be required to adhere to Federal regulations regarding development near the nest.

A Letter of Concurrency from the Volusia County School District acknowledging adequate capacity will also be required prior to the issuance of a development order.

City Council approved the request at first reading on July 6, 2020.

Land Use Compatibility: The surrounding area consists of single family homes and the Glenbrooke subdivision, which is under construction, to the north.

Adequate Public Facilities: The subject property has access via Air Park Road. The installation of all required infrastructure, including but not limited to interior roads, utilities, stormwater retention and recreation and open space will be the responsibility of the developer.

Comprehensive Plan Consistency: The proposed Future Land Use designation is consistent with properties to the north and south. The proposed amendment also meets Objectives 1.4 (Discourage Urban Sprawl and Encourage Redevelopment) and 1.5 (Future Land Use Compatibility) of the Future Land Use Element.

The existing Volusia County Future Land Use designation of Urban Low Intensity allows for up to four (4) dwelling units per acre and is generally characterized by single family type housing, attached and detached.

The proposed Low Density Residential Future Land Use designation allows for up to four (4) dwelling units per net acre, therefore a reduction in the number of dwelling units permitted on the property could be seen.

Per Policy 1.1.8 areas with the Conservation Overlay may contain wildlife habitat for rare and/or endangered species and/or wetlands. Development approval will be subject to an Environmental Impact Study as to the extent of the impact of development or redevelopment for any lands within Conservation Overlay areas. If an area within the Conservation Overlay area is determined to be developable and all mitigation requirements have been met, then the underlying land use on the Future Land Use Map will apply.

RECOMMENDED ACTION

Motion to approve Ordinance No. 2020-O-11.
