Staff Findings:
The applicant is requesting to annex the properties from unincorporated Volusia County into the City of Edgewater. The subject property is located within the Interlocal Service Boundary Agreement (ISBA).
The applicant had a pre-application meeting with Development Services. Development Services advised the applicant the applicable future land use to request would be Low Density Residential with a Conservation Overlay and a zoning designation of R-2. The applicant has requested what staff advised.
The applicant would like to process two lot combinations to combine the listed parcels into two lots to build two homes on the respective parcels after the annexation, rezoning, and small-scale comprehensive plan amendment.
The subject property is in an enclave of unincorporated properties within the city’s ISBA.
The subject properties are 1.13 + acres.
The subject property has a future land use (FLU) designation of Volusia County Environmental System Corridor (ESC) and Urban Low Intensity (ULI), which respectively allows for up to 1 dwelling unit per twenty-five (25) acres and 4 dwelling units per acre.
The subject property has a current zoning designation of Volusia County Resource Corridor (RC) and Urban Single-Family Residential (R-3A).
The zoning designation of R-2 has the following parameters according to Table V-1 within Article V of the City of Edgewater’s Land Development Code:
Minimum Lot Square Footage = 10,000 square feet Minimum Lot Width = 80 feet
Minimum Lot Depth = 125 feet Minimum Front Yard Setback = 30 feet
Minimum Rear Yard Setback = 20 feet Minimum Side Yard Setback = 10 feet
The R-2 zoning designation according to Article 3 of the land development code within Table III allows for the following types of residences:
• Residential - Modular Home
• Residential - Single Family
Public Comment:
Staff received one phone call from a member of the public with questions regarding the application. Concerns were raised that the City was attempting to annex all properties within this area. Staff opinioned that the intention is to only annex these unincorporated properties when requested by staff and allowed by the ISBA. Staff relayed that the citizen could attend and voice his concerns to the board on October 11th.

The application is to annex five (5) consecutive vacant parcels along Elizabeth Street, each 50x200, with intention to combine and subdivide into two (2) single family residences: Future Parcel A @ 100x200 and Future Parcel B @ 150x200. The subject property is within City of Edgewater Interlocal Service Boundary Area and is adjacent to two (2) vacant parcels along Elizabeth Street, each 50x200, that were annexed in 2014. The property is within the City of Edgewater Utility Service Area for Potable Water, Sanitary Sewer, and Reclaimed Water service.
Recommendation:
Environmental Services recommends annexation. Environmental Services defers to other Departments regarding the rezoning and future land use designations.
1. Streets: Access to the properties will each require a concrete apron connecting to Elizabeth Street. Elizabeth Street is owned by Volusia County and driveway access will require a County Right-of-Way Use permit.
2. Potable Water: A City-owned water main is present in the Elizabeth Street right-of-way which is ready to serve the properties. Impact fees and other connection fees will be due at time of construction. The properties lie in between two existing fire hydrants: at the SE corner of Claudette Street intersection and at the northeast corner of 1386 Elizabeth Street.
3. Sanitary Sewer: There is no central sewer utility currently available in the vicinity. All developed properties along Elizabeth Street utilize septic tanks and onsite effluent drain-fields. Applicant should contact the Florida Department of Health in Volusia County regarding permitting and construction of septic tanks & drain-fields on the properties.
4. Reclaimed Water: There is no reclaimed water utility currently available to serve the irrigation needs of this property. ES would not object to private irrigation wells permitted thru the Florida Department of Health.
5. Solid Waste and Recycling: ES will provide roadside collection of residential garbage and recycling for these properties along Elizabeth Street.
6. Stormwater: Construction on the vacant properties will require, at minimum, onsite retention of 1-inch of runoff over the entirety of parcel with discharge routed to the roadside swale system along Elizabeth Street. Since the stormwater system along Elizabeth Street is owned by Volusia County, a County-issued drainage permit may be required.
Staff Recommendation:
Staff recommends the Planning and Zoning Board send a favorable recommendation to City Council for CPA-2304.
