SUMMARY:

The applicant is requesting to annex the property from unincorporated Volusia County into the City of Edgewater. The subject property is located within the Interlocal Service Boundary Agreement (ISBA).

 

The applicant did not request a zoning designation or a future land use designation. The applicant would like to process a minor lot split and build two homes on the respective parcels after the annexation, rezoning, and small scale comprehensive plan amendment.

 

The subject property is in an enclave of unincorporated properties within the city’s ISBA.

 

The subject property is 7 + acres.

 

The subject property has a current zoning designation of Volusia County Agriculture (A-3).

 

The subject property has a future land use (FLU) designation of Volusia County Urban Low Density which allows for up to 4 units per acre.

 

City staff is requesting for the applicant to a comparable future land use designation of Low Density Transition. The Low Density Transition FLU allows for a density of 1 dwelling unit per acre.

 

City staff is requesting for the applicant to the corresponding zoning designation of Rural Transition which has the following parameters according to Table V-1 within Article V of the City of Edgewater’s Land Development Code:

 

Minimum Lot Square Footage = 1 acre                                          Minimum Lot Width = 100 feet

Minimum Lot Depth = N/A                                                                                    Minimum Front Yard Setback = 40 feet

Minimum Rear Yard Setback = 40 feet                                          Minimum Side Yard Setback = 25 feet

 

The Rural Transition zoning designation according to Article 3 of the land development code within Table III allows for the following types of residences:

 

                     Residential - Manufactured / Mobile Homes

                     Residential - Modular Home

                     Residential - Single Family

 

Public Comment:

 

Staff received one phone call from a member of the public with questions regarding the application. Concerns were raised by this individual that the applicant could place duplexes or multi-family style residential units. Staff told the individual that the proposed zoning and future land use would be restricted to the above-mentioned type of residences. The citizen appeared to be not concerned as long as the applicant did not build denser style of residential units on the subject property. Staff relayed that the citizen could attend and voice his concerns to the board on August 9th.

The Planning and Zoning Board on September 13th voted to send a favorable recommendation to City Council on a 6-0-1 vote.
