The Deering Park North MUPUD Agreement, Ordinance No. 2021-O-09, recorded in Book 8135, Page 2309, required a utility agreement between the developer and the City of Edgewater. The MUPUD agreement requires the development to shall connect and utilize the City’s water and wastewater transmission, distribution, and collection systems.
The purpose of the utility agreement is as follows:
1. To document plans for the phased wastewater transmission infrastructure improvement and plant expansion, including schedules.
2. To require the funding of certain wastewater utility system improvements for the benefit of the City by the payment of advanced impact fees.
3. To establish a funding strategy for these improvements including cost sharing from all new development connecting to these improvements.
4. To confirm impact fee credits for the engineering work completed to date and anticipated to be completed as a cost associated with Qualifying Improvements on behalf of the City in accordance with that certain Capital Improvement and Impact Fee Credit Agreement dated October 11, 2021, between the City and Farmton North, LLC (Impact Fee Credit Agreement);
The utility agreement within exhibit A establishes the timeframe of new residential development within Deering Park and within the City of Edgewater. The utility agreement provides for an upfront payment of impact fees in lieu of waiting for impact fee payment at the time of building permits. The prepayment of impact fees will enable the City to expand the wastewater plant. The utility agreement also establishes the responsibilities of each party regarding infrastructure improvements. Deering Park is responsible for Lift Station 40 as well as their respective capacity for the force main on Indian River Boulevard. The City is responsible for expanding capacity at the wastewater treatment plant. The agreement also gives an impact fee credit of $93,460 for the work Deering Park performed. Deering Park hired several companies to perform a detailed analysis and report about the City of Edgewater’s wastewater utilities. The report provided substantial knowledge about the City’s utility systems that the City did not have. The prepayment of impact fees reserves capacity for Deering Park Phase 1.
