Background: The subject property is currently vacant and located east of Air Park Road, north of 22nd Street and south of the new Glenbrooke subdivision.

Amendments to the Future Land Use and Zoning Maps shall occur simultaneously with the annexation.

The applicant is proposing to develop the property with 111-unit townhouse units. The PUD Agreement associated with the Zoning Map amendment shall address development requirements including, but not limited to, setbacks, required infrastructure and ownership and maintenance of all common areas.

Prior to development of the subject property a Preliminary Plat and Subdivision Construction Plans or Site Plan must be approved. A Traffic Impact Analysis and Environmental study, to include listed species and wetlands, shall be reviewed with the constructions plans; any improvements and/or required mitigation will be the responsibility of the developer. A bald eagle nest has been identified on the subject property; the developer will be required to adhere to Federal regulations regarding development near the nest.

A Letter of Concurrency from the Volusia County School District acknowledging adequate capacity will also be required prior to the issuance of a development order.

As the property exists today the City could see $760.00 in annual tax revenue; upon development the tax revenue could potentially increase up to $193,520 annually (based on unit value of $250,000/no homestead exemption, 2020 tax rate) and approximately $835,654 in impact fee revenue.

City Council approved the request at first reading on July 6, 2020.

Land Use Compatibility: The surrounding area consists of single family homes and the Glenbrooke subdivision, which is under construction, to the north.

Adequate Public Facilities: The subject property has access via Air Park Road. Construction of all required infrastructure, including but not limited to interior roads, sidewalks, utilities, stormwater management, and recreation and open space will be the responsibility of the developer.

Comprehensive Plan Consistency: Annexation of the subject property is consistent with Objective 1.8 of the Future Land Use Element, which identifies policies for the most efficient use of public facilities and services, eliminating areas of jurisdictional problems and provides for sound growth and development of the City and surrounding area.

Policy 1.8.1 -Interlocal Agreement with Volusia County. The City will maintain the interlocal agreement (ISBA) with Volusia County regarding a joint planning area, annexation boundaries, urban service boundaries through compatible County and City land uses. The subject property lies within the annexation boundaries set forth in the Interlocal Agreement with Volusia County adopted in 2015.

Policy 1.8.3 - Annexation of New Development. New development proposed within the County in areas that are contiguous to the City shall be annexed into the City and developed to City standards as a condition for the extension of public utilities. The subject property is contiguous to the City on north, south and west.
