Staff Review
The applicant is requesting a conditional use permit for a Warehousing and Storage use, as well as, allow an ice vending machine within the B-3, Highway Commercial zoning district for the property located on 601 N. Ridgewood Avenue. The subject property is located on the east side of U.S.1 and currently the parcel is partially vacant. The property has an ice vending machine and a restroom; however, the applicant is asking to have a carport added to the parcel to allow for storage. During the review of the conditional use application, it was discovered the ice machine did not have a previous issued conditional use permit on file. Therefore, it has been added to this request in an effort to bring the parcel into conformity. The applicant originally applied for variances before the Planning and Zoning Board to facilitate a food truck venue. The applicant is now requesting to convert the food truck venue to outdoor covered storage for his personal business.
A warehousing and storage use is listed as conditional within Article III, Section 21-33.05, Table III -3. As such, the use of warehousing and storage requires a conditional use permit within the B-3 Highway Zoning District. The business will not create a use that could be deemed detrimental to the neighborhood.
Staff has reviewed the three subsections within Section 21-92.04 for Conditional Use Permits and found the request is in compliance with the current requirements. Section 21-92.04 states “In order to approve a CUP the P&ZB must make a finding of fact that the Conditional Use Permit:
a. Is consistent with applicable land development regulations for the zoning district in which the property is located;
b. Is compatible with existing and proposed uses in the adjacent area; and
c. Meets the Concurrency Management System requirements described in Article XI.”
Staff has reviewed the subject property with the surrounding land uses and zoning districts and has found the use compatible with the proposed uses in the adjacent area. Staff did not receive comments from other departments nor did staff receive any public comment from the public notice. The original site plan was approved for a food truck court with a restroom and parking on N. Ridgewood Avenue. The applicant is proposing the partially enclosed carport will be placed behind a fence and not be viewable from the right-of-way.
City staff believe the current layout of the site is conducive to having the warehousing and storage use and meets the Transportation Concurrency Management System. During the original Planning and Zoning hearing for the variances to allow the food truck court, the adjacent neighbor expressed concerned about odor and noise. The site has access to utility connections to water and sewer as well as trash services. At this time reclaimed is not available.
