SUMMARY:

Under Florida Statute 337.403 local governments have used home rule authority to conduct local transportation projects and require electric and other utilities to relocate utility equipment when necessary and to require the utilities to pay for such relocation projects.

 

HB 391 and SB 896 would require local governments to pay the cost of utility relocation, thereby putting the burden on the local government and its constituent taxpayers.  Transportation projects are often the catalyst for economic development and therefore, it is beneficial to the local governments and tax payers to urge the Florida Legislature to not agree to take up these matter or any further attempts to limit local government’s ability to serve its citizens.
